Acceptance of Terms

By accessing or using the Artic Mini Splits website at articminisplits.com ("Site"), requesting a quote, placing an order, or scheduling installation services, you ("Customer") agree to be bound by these Terms and Conditions ("Terms") in their entirety.

These Terms constitute a legally binding agreement between you and Artic Mini Splits ("Company," "we," "us," or "our"), a business operating in the Dallas–Fort Worth metroplex and East Texas area. If you do not agree to these Terms, you must not use our Site or services.

Services & Pricing

Artic Mini Splits provides ductless mini split air conditioning and heating unit sales, delivery, and professional installation services. Quoted prices are estimates and subject to the following conditions:

• Unit pricing is based on BTU size and availability at time of purchase. Prices are subject to change without notice until an order is confirmed in writing.
• Standard installation pricing applies to single-story, exterior-wall installations with easy equipment access. Additional charges may apply for brick drilling, second-story or above-grade installations, attic line-sets, or unusually long line-set runs.
• Multi-unit installation discounts are available when units are installed at the same address on the same day.
• Shipping charges of $49.95 apply to orders delivered within the DFW metroplex. Rates for orders outside standard service areas will be quoted separately.
• All prices are listed in U.S. dollars and do not include applicable sales tax, which will be calculated and applied at checkout or invoicing based on the Texas state rate (currently 8.25%).

The online quote estimator is provided for convenience and approximation only. Final pricing is confirmed upon review of your specific installation site and requirements.

Installation Policy

Professional installation is performed by Artic Mini Splits technicians in accordance with manufacturer specifications and applicable Texas codes. The following conditions apply:

• Site Readiness: The Customer is responsible for ensuring the installation site is accessible, clear of obstructions, and safe for our technicians to work.
• Electrical Requirements: Mini split units require a dedicated electrical circuit. The Customer is responsible for ensuring the appropriate circuit (typically 240V/15A or 240V/20A) is available and code-compliant prior to the scheduled installation date. If required electrical work is not complete, a rescheduling fee may apply.
• Permits: Installation of HVAC equipment may require permits in certain municipalities. The Customer is responsible for verifying local permit requirements and obtaining any necessary permits before installation. We are happy to advise, but permit procurement is the Customer's responsibility unless otherwise agreed in writing.
• Property Modifications: Installation requires penetrating exterior walls for line-set and drain line routing. The Customer consents to such modifications and acknowledges that minor cosmetic work (patching, painting) after installation is the Customer's responsibility.
• Access: An adult (18+) must be present at the property for the duration of the installation. Failure to provide access at the scheduled time may result in a trip fee or forfeiture of deposit.

Payments & Deposits

The following payment terms apply to all orders and services:

• Unit-Only / Shipping Orders: Payment is collected in full at time of order. Orders are not confirmed until payment is received.
• Installation Packages: A deposit (as shown on your invoice or quote) is required to reserve your installation date. The remaining balance is due upon completion of the installation before the technician leaves the property.
• Accepted Payment Methods: We accept major credit/debit cards, cash, Zelle, and other electronic payment methods as indicated at checkout. Personal checks are not accepted.
• Failed Payments: If a payment fails or is reversed, any scheduled services will be placed on hold and the Customer will be notified. Outstanding balances may incur late fees.
• Financing: Any third-party financing options advertised on our Site are subject to that provider's separate terms and approval process. Artic Mini Splits is not a lender and bears no responsibility for financing decisions.

Cancellation & Rescheduling

We understand plans change. The following policy applies:

• Cancellation with 48+ hours notice: Full deposit refund.
• Cancellation with 24–48 hours notice: 50% of deposit retained as a scheduling fee.
• Cancellation with less than 24 hours notice or same-day no-show: Deposit is non-refundable.
• Rescheduling: One free reschedule is permitted with at least 24 hours notice. Additional rescheduling requests may incur a $50 rescheduling fee.
• Company Cancellations: If Artic Mini Splits must cancel a scheduled appointment due to weather, equipment availability, or other unforeseen circumstances, we will notify you as soon as possible and reschedule at no additional charge, or provide a full refund of any deposit paid.

Unit-only orders that have already shipped cannot be cancelled. Please refer to the Returns section below.

Warranty & Returns

Equipment Warranty: All units sold by Artic Mini Splits carry the manufacturer's limited warranty. Warranty terms vary by brand and model; please refer to the documentation included with your unit. Warranty claims are processed through the manufacturer. We are happy to assist with the process where possible.

Labor Warranty: We warranty our installation workmanship for a period of 90 days from the date of installation. If a defect in our installation work is identified within this period, we will return to inspect and correct it at no charge.

What Voids Warranty:

• Unauthorized modification or tampering with the unit or installation.
• Damage caused by power surges, improper electrical supply, flooding, or acts of nature.
• Failure to operate the unit within manufacturer-specified parameters.
• Units not installed by Artic Mini Splits (labor warranty only).

Returns: Unused, unopened units may be returned within 14 days of delivery for a refund, minus a 15% restocking fee and original shipping costs. Units that have been installed, powered on, or show signs of use are not eligible for return. To initiate a return, contact us at (469) 637-4051.

Limitation of Liability

To the fullest extent permitted by applicable law, Artic Mini Splits, its owners, employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with the use of our Site, products, or services, including but not limited to:

• Loss of use, revenue, or profits;
• Property damage not directly caused by our gross negligence;
• Data loss or security breaches;
• Delays in installation or delivery caused by events outside our control (including weather, supply chain disruptions, or acts of God).

Our total aggregate liability to any Customer for any claim arising under these Terms shall not exceed the total amount paid by that Customer for the specific service or product giving rise to the claim.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

Intellectual Property

All content on this Site — including text, graphics, logos, images, photographs, button icons, and software — is the property of Artic Mini Splits or its content suppliers and is protected by applicable U.S. copyright and intellectual property laws.

You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of our Site or its content without our express written permission. You may print or download content for personal, non-commercial reference only.

Product names, brand names, and trademarks referenced on this Site remain the property of their respective owners. Their mention does not imply endorsement or affiliation.

Privacy & Data

We are committed to protecting your personal information. When you use our Site or request services, we may collect:

• Contact information (name, phone number, email address);
• Service address and property details for installation planning;
• Payment information (processed securely through our payment processor — we do not store full card numbers);
• Website usage data via Google Analytics (anonymized, aggregated).

We use this information solely to provide our services, communicate with you about your order or appointment, and improve our offerings. We do not sell, rent, or share your personal information with unaffiliated third parties for marketing purposes.

Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms, your use of our Site, or our services shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Kaufman County, Texas, in accordance with the rules of the American Arbitration Association. Judgment on any arbitration award may be entered in any court of competent jurisdiction.

You agree that any claim must be brought in your individual capacity, and not as a plaintiff or class member in any purported class action or representative proceeding.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to this page, with the "Last Updated" date revised accordingly.

Your continued use of our Site or services after any such changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically. For material changes, we will make reasonable efforts to notify customers via email or a prominent notice on our Site.
